Privacy Policy

We collect the personal information of our employees, potential employees, clients, service providers, suppliers, visitors, attendees of events that we host, and business contacts. Where information we collect from or about an individual is not listed in this privacy statement, we will provide (when required by law) the relevant individuals appropriate notice of which other information will be collected and how it will be used. If you have an employment-related relationship with us (e.g., you are an Accenture Federal Services employee, independent contractor or consultant, subcontractor or supplier, or potential or former employee), please review our HR Privacy Statement.

Accenture Federal Services does not collect, use, share, or disclose your personal information unless: (i) it is lawful to do so, (ii) we have a specific business purpose for doing so, and (iii) one of the following conditions is met:

• You have consented to our processing of your information, to the extent such consent is mandatory under applicable laws, and have not subsequently withdrawn that consent; or
• If consent is not legally required, we will process personal information only to the extent necessary to:

 

Establish and maintain contractual relationships, for example:

• Facilitating communications with clients and service providers;
• Managing and administering the work activities of our employees;
• Establishing relationships with new clients;
• Fulfilling our obligations to current clients;
• Contacting clients regarding account-related issues and business communications, including technical notices, updates, security alerts, and administrative messages; and
• Enabling individuals to access and use our services.

 

Comply with our legal obligations and government regulatory requirements, for example:

• Demonstrating compliance with applicable privacy and data security laws;
• Complying with incident monitoring, reporting, assessment, and notification requirements;
• Complying with other applicable criminal and civil law and regulatory requirements under federal, state, and international law;
• Complying with regulatory obligations, such as income tax, mandatory filings, record-keeping, and reporting obligations; and
• Conducting audits and complying with government inspections and other requests from government or other public authorities.

 

To provide services and information that you request and consent to receive, for example:

• Providing customer service and support;
• Facilitating communications with you, including responding to your comments, questions, and requests;
• Authorizing your access to Accenture Federal Services facilities; and
• Facilitating your attendance at Accenture Federal Services events and activities.

 

To fulfill our other legitimate interests to the extent that they are not overridden by individual interests, fundamental rights, or freedoms, for example:

• Administering, operating, maintaining, and securing our website;
• Improving the security and functioning of our website, networks and information systems;
• Investigating and preventing fraudulent transactions, unauthorized access to our website and information systems, and other illegal activities;
• Verifying compliance with our internal policies and procedures;
• For accounting, recordkeeping, backup, and administrative purposes;
• Customizing and improving the content of our communications and website;
• Providing information and education;
• Providing, operating, managing, maintaining, improving, personalizing, and promoting our business activities;
• Conducting market research and marketing our products and services (first-party marketing only; we do not provide personal information to third parties for use in marketing any non-Accenture Federal Services goods or services), unless you have objected to such processing as described in the section “Your control over your information”;
• Implementing, maintaining, and updating our Customer Relationship Management (CRM) database;
• Social listening, i.e., identifying and assessing what is being said about Accenture Federal Services and our clients and projects on social media (only publicly accessible content) to understand sentiment, intent, mood and market trends and thereby improving our services. We do this through key-word searches and our goal is to gain insights in conversation trends over a specified period and not to identify an individual. To achieve this, we analyze and monitor conversation streams and monitor publicly available opinions, statements or other interactions on social media channels;
• Performing data analytics, i.e., applying analytics to business operations and data to describe, predict, and/or improve business performance within Accenture Federal Services and/or to improve employee and user experiences; and
• Protecting, enforcing, or defending the legal rights, privacy, safety, and/or property of Accenture Federal Services and its employees or agents.

We may also process your personal information where required to protect the vital interests of the individual concerned or another individual in a “life or death” situation, or to perform a task carried out in the public interest, including activities relating to public health, public benefits, insurance, and privacy and civil liberties.

To the greatest extent possible, we will use aggregated, deidentified, or otherwise anonymized data (non-personal information) to accomplish these purposes, but if we do not, or if we combine non-personal information with personal information, we will continue to treat it as personal information in accordance with this privacy statement.

We may disclose your personal information to our service providers, professional advisors, public and governmental authorities, Accenture companies/affiliates or third parties in connection with Accenture Federal Services’ operation of its business, including any (potential) corporate or commercial transaction. Such third parties may be located in other countries. We do not sell, transfer, or otherwise disclose personal information that we collect from or about you except to the extent necessary to fulfill our business purposes and obligations, to accomplish one of the lawful purposes described in this privacy statement, or in response to your express instructions.

With your express consent: We will share your personal information with companies, organizations, or individuals outside of Accenture Federal Services when we have your prior express consent or when you ask us to do so.

 

When you choose to directly share your information on our website or your usage: When you use our website, certain features allow you to make some of your usage and content accessible to the public, directly or through links to social media platforms. We urge you to consider the sensitivity of any information prior to sharing it publicly or with other users. Social media platforms have their own privacy policies, and may collect and use your information in different ways. You should understand how those sites collect and use your information.

 

With our service providers, business partners, and others to accomplish our business purposes as stated in this privacy statement: We may share your information with other Accenture entities that provide support services to Accenture Federal Services, and also with unrelated third-party service providers who perform services on our behalf, such as infrastructure, administrative support, auditing, security and performance monitoring, analytics, advertising and marketing services, data hosting, and online services.

 

When necessary to comply with laws and law enforcement requests or otherwise to protect Accenture Federal Services, its clients, and individuals: We may disclose your information to a third party:

• If we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, legal process, or governmental request;
• To enforce our agreements, policies and terms of service;
• To protect the security or integrity of Accenture Federal Services products and services;
• To respond to an incident involving personal information for which Accenture Federal Services has direct or indirect responsibility;
• To protect the property, rights, and safety of Accenture Federal Services, our clients, or the public, including to protect against fraud and malicious activity;
• To prevent harm or illegal activities;
• To respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person; or
• To investigate and defend ourselves against any third-party claims or allegations.

 

As the result of a business transition: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of Accenture Federal Services assets, financing, or acquisition of all or a portion of our business to another entity. We will take reasonable steps to assure that any other entity involved continues to comply with the terms of this privacy statement. We will notify you of such a change in ownership or transfer of assets, to the extent we are able to do so, by posting a notice on our website.

 

Sharing aggregate, anonymized, deidentified, or otherwise non-personal information: We may share personal information that has been aggregated, deidentified, or otherwise anonymized sufficiently that the individual is no longer identified or identifiable and cannot be reidentified using reasonable efforts, resources, and technology (i.e., non-personal information). That non-personal information is outside the scope of this privacy statement and applicable privacy laws.

ALL INDIVIDUALS

You may be entitled, where provided for under applicable law, to:

• Decline to share certain personal information: If you decline to share certain personal information, we may not be able to provide you with some of the features and functionality of our website or fulfill your requests.
• Opt-out of receiving communications: You may opt-out by using the unsubscribe link within each email. Note that, as long as you maintain an account with us, you will continue to receive administrative messages from us regarding our services.
• Request rectification of your personal information: You may ask us to correct or update your personal information if it is inaccurate or incomplete.
• Object to the processing of your personal information: You may ask us to stop processing your personal information.
• Withdraw consent for processing personal information: To the extent that our processing of your personal information is based on your consent, you have the right to withdraw such consent at any time by contacting us. Please note that this will not affect Accenture Federal Services’ right to process personal information obtained prior to the withdrawal of your consent, or its right to continue parts of the processing based on other legal bases than your consent.
• Request access to the personal information we process about you: You may request information about, and access to, the personal information that we have collected from you.
• Submit a question or complaint: You may contact us with a question or complaint about this privacy statement, your personal information, or our data security practices with regard to your personal information. If, despite our commitment and efforts to protect your personal information, you believe that your data privacy rights have been violated, we encourage and welcome you to come to Accenture Federal Services first to seek resolution of any complaint.
• Assert other legal rights: You may assert other legal rights with regard to our collection and use of your personal information under applicable federal, state, and international law.

CALIFORNIA RESIDENTS

The California Consumer Privacy Act provides California residents with the following additional rights:

• Right to be informed: California residents have the right to receive a privacy notice with information about what personal information we have collected or disclosed for business purposes and sold during the preceding 12 months. This privacy statement provides information about the categories of information that we have collected, the sources of that information, the purposes for which we have used the information, and the categories of third parties to whom we have disclosed the information for business purposes.

 

• Right to know: If you are a California resident, you have the right to request that we disclose the personal information we have collected about you in the preceding 12 months, including:
  • The categories of personal information we have collected about you;
  • The categories of sources from which the personal information is collected;
  • The purpose for collecting your personal information;
  • The categories of third parties with whom we have shared your personal information; and
  • The specific pieces of personal information we have collected about you.

 

• Right to deletion: If you are a California resident, you have the right to request that we delete the personal information that we have collected from you and to direct our service providers to do the same. Please note that there are exceptions to this right, including, when the information is necessary for us (or our service providers) to:
  • Complete the transaction for which personal information was collected;
  • Provide a good or service;
  • Perform a contract between us and you;
  • Detect, protect against, and/or prosecute those responsible for security incidents and malicious, deceptive, fraudulent, or illegal activity;
  • Debugging efforts to identify and repair any errors that impair functionality of our systems or website;
  • Protect free speech rights;
  • To enable internal and lawful uses that are aligned with the context in which the personal infromation was provided; or
  • Comply with a legal obligation.

 

• Right to opt-out of sale: If you are a California resident, you have a right to opt out of the “sale” of your personal information. This right is applicable to the extent that Accenture Federal Services is engaging in a “sale” of your personal information as that term is defined under the California Consumer Privacy Act. Accenture Federal Services and ASM Research do not sell personal information.

 

Additionally, California Civil Code Section 1798.83 permits website users who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please contact us.

 

Exercising your rights

To exercise the rights available to you, please contact us. Once we receive your request, we may verify it by requesting information sufficient to confirm your identity. Where necessary, this may include asking you for a copy of your passport or driver’s license. If you would like to use an authorized agent to exercise your rights, we may request evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. We reserve the right to deny requests from authorized agents in certain circumstances, such as where we have a reasonable belief that the request is fraudulent.

If you choose to exercise your rights, you will not be charged different prices or provided a different quality of services unless those differences are related to the provision of your personal information or otherwise permitted by law.

Security

Accenture Federal Services uses reasonable organizational, technical, and administrative measures to provide a level of security appropriate to the risk associated with the personal information that we collect. We protect personal information under our control – and we require other Accenture entities and the third-party service providers that we work with to protect – against accidental or unlawful destruction, loss, alteration, unauthorized disclosure of or access. Only authorized employees have access to the data you provide, and that access is limited to least privileged, need to know access. Accenture Federal Services employees who have access to your personal information have agreed to maintain the confidentiality of that information.

Unfortunately, no data transmission over the Internet or via email and no data storage system can be guaranteed to be 100% secure. Although we strive to protect the information in our control, we cannot guarantee the security of our database, nor can we guarantee that the information you provide will not be intercepted while being transmitted over the Internet.

 

Where your personal information is stored and/or processed

Accenture Federal Services is a U.S.-based company that provides U.S. and international services under contract to U.S. federal government entities. As a result, information that we collect, including personal information, may be transferred to our U.S. offices to permit us to comply with our legal and contractual obligations, to provide information and services to prospective and current clients, and to perform related business activities. In addition, we may work with other Accenture entities and with third-party service providers in the U.S. and in other countries to support our business activities. Thus, personal information may be transferred to, stored on servers in, and accessed from the U.S. and countries other than the country in which it was initially collected. In all such instances, we use, transfer, and disclose personal information solely for the purposes described in this privacy statement.

Except to the extent limited by U.S. law and by Accenture Federal Services’ contractual obligations to the U.S. federal government, Accenture Federal Services complies with applicable international law regarding the protection of personal information (“International Privacy Law”). For additional information, including with regard to personal information collected from individuals based in the European Economic Area (EEA), see “Our Compliance with International Privacy Law” section below.

 

Data retention

Accenture Federal Services retains information, including personal information, only as long as necessary to accomplish the business purpose for which it was collected and to comply with its legal and contractual obligations, plus 1 year, and then securely disposes of that information or converts it into non-personal information by aggregating it, de-identifying it, or otherwise anonymizing it so that it does not directly or indirectly identify you and cannot, with reasonable efforts, resources, and technologies, be used to re-identify you.

Our website and the services we provide to our clients are not directed to or intended for individuals under the age of 16. Without affirmative authorization, we do not knowingly collect personal information from children under 16 years of age, nor do we sell the personal information of children under 16 years of age. If we become aware that a child under the age of 16 has provided us with personal information, we will take steps to delete such information. If you become aware that a child under the age of 16 has provided us with personal information, please contact us.

Except to the extent limited by U.S. law and by Accenture Federal Services’ contractual obligations to the U.S. federal government, Accenture Federal Services complies with applicable International Privacy Law, including with regard to transfers of personal information from one country to another.

Accenture Federal Services only transfers personal information from the EEA to the U.S. consistent with the practices described in this privacy statement, and then only with the individual’s consent, in furtherance of an agreement, in compliance with Accenture Federal Services’ legal obligations, or in connection with Accenture Federal Services’ legitimate business interests.

We respect data transfer laws when transferring personal information from the EEA to the U.S. or to other Non-EEA countries.

When we transfer personal information to a country that the EU has determined does not provide adequate protection, we put in place appropriate safeguards. In particular, we enter into data processing and data transfer agreements that incorporate the EU Standard Contractual Clauses.

For personal information that we receive from another Accenture entity or that we transfer to another Accenture entity, we have put in place an intercompany data transfer and data processing agreement that incorporates the EU Standard Contractual Clauses.

For transfers of personal information from the EEA to third-party service providers, we have also put in place data transfer and data processing agreements that incorporate the EU Standard Contractual Clauses or, as appropriate, acknowledge the existence of and third party adherence to other EU-compliant data transfer mechanisms.

In exceptional cases, where we are not able to rely on data transfer agreements or other recognized compliant data transfer mechanisms for the transfer of your personal information to a country not offering adequate protection, we will only do so after having obtained your consent, or if necessary for the performance of an agreement concluded between us or in your interest, or if necessary for the establishment, exercise or defense of legal claims.

Accenture Federal Services may change and update this privacy statement from time to time, including materially changing the use made of personal information described herein.
